ASSIST AND THE SECURITY PROFESSION IN TEXAS

On June 24, the Sunset Advisory Committee met to review DPS and the Private Security Bureau. I stated in my last column that I would be there to testify on behalf of DPS. Due to a scheduling conflict, I was not able to testify, but I did provide the committee a letter from ASSIST and Austin Regional President Alan Treviño was there on our behalf. As stated earlier, ASSIST wants the security profession to remain professional, and with the assistance of DPS we can certainly accomplish these goals.

One of the areas of concern was increasing the administrative penalty to $5,000 per day. We testified that we want DPS to continue to press for the most severe penalties for the most heinous violations of the act and board rules. As you are aware, there have always been unlicensed security companies operating in Texas; they set up security business without registering with PSB or DPS. What happens is that they take away business that should be with the licensed companies. Please continue to help to put a stop to this type of activity.

Finally, I want to add that I want to see the PSB continue to have the authority to hear appeals on fines levied by investigators and then perhaps on to district court if no agreement is reached. We want the penalty to continue to fairly match the infraction. The board rules and statutory requirements require necessary but nonetheless complicated paperwork.

Again, I appreciate the work of the Sunset Commission staff and we look forward to participating throughout the Sunset process. As your president, I will continue to keep you informed.
